National Green Tribunal

Recently, the NGT (National Green Tribunal) has imposed stay on the permissions of all new building construction which comes in the vicinity of the Sanjay Gandhi National Park and it is expected that this move can leave negative impact on the several proposed real estate projects which are in the western and eastern suburbs of Mumbai and Thane district. But still it’s not specified that exact how much area around the national park comes under this decision and due to that according to reports NGT stay on new construction which is around the Sanjay Gandhi Park.
The National Green Tribunal has directed the municipal authorities of Mumbai to not to grant any permission for further construction until National Board of Wild Life or Union Ministry of Environment and Forests  both notify a proposal of the state government to declare that all area around the national park are an eco-sensitive zone. However; there is chaos because tribunal has not specified the range of area around the national park where new construction project permissions need to be held back.

When social activist Santosh Daundkar filled petition, so while hearing the case NGT gave the order by stating that a real estate project of Omkar Realtors and Developers at Malad is located very close to the Sanjay Gandhi National Park. However; advocate Aditya Pratap, who was representing the petitioner stated that in the year 2003, the SC had given a judgement to restrict the mining activity in the rnage of 10-km radius which comes under the national parks and if anyone needs to the mining activity so they have to take the clearance from NBWL. We all know that building construction involves escalation of sand and minor minerals, so the real estate project of Omkar Realtors and Developers at Malad could not have received a green clearance from the standing committee of the NBWL”.

According to the spokesperson of Omkar Realtors and Developers¸ “The National Green Tribunal order has no impact on any ongoing real estate project within the Mumbai because all future projects within 10 km of the Sanjay Gandhi National Park will need no-objection certificate from NBWL, and it is nothing than the another permission which will delay the launch of the real estate projects, and it will also increase the cost of project, whereas; on the other side real estate industry will suffer from low supply of goo apartments in short run. The more he added that in the present project, the previous order which was dated on the February 2, 2015 to inform the prospective buyers about the pendency of the litigation in this tribunal be abide by scrupulously.

However; NGT has not issued any stay on the construction activities at Omkar Realtors’ project which is coming at Malad, it has only directed the real estate developer to inform prospective buyers about the litigation.

Guardian minister_Thane_Ekanath Shinde

This project will need more than Rs. 30, 000 crore and it will be prepared on the model of German technology. After construction and execution, this road will cut the travel time by 80 minutes (from 90 minutes to 10 minutes). It is expected that this tunnel will deviate from Tikujiniwadi to Ghodbunder Road and it will cover more than 15 kms under the ground through Yeoor and Sanjay Gandhi National Park. It will also connect the WEH (Western Express Highway) at Borivli as currently, Thane and Borivali, which is located in North Mumbai are separated by chain of hills (most of the chain of hills are the part of the national park).

Eknath Shinde, who is Guardian minister for Thane and the minister for Public Works Department (PWD), announced that Maharashtra State Government is planning to enhance the connectivity of Thane with rest of the Mumbai. Shinde has announced a special six lane underground road which will connect Thane and Borivali and apart from that he has also received an approval for other flyover projects within the Thane region and for that Maharashtra State Government has granted Rs 517 crores. He also stated that roads are the important part of infrastructure as well as for the progress of city, but it is also essential to focus on the maintenance of road services. The more he added that in future the regions like; Kasarvadavli, Bhayanderpada, Anandnagar, and Mulund Toll Naka will have the mushrooming flyovers, which will help people to travel in less time as well as they will help to decrease the traffic issues.

Now MSRDC (Maharashtra State Road Development Corporation) is ready with preliminary reports and they have appointed consultant to execute the project. Apart from that State Government of Maharashtra, has also approved the widening of Kalyan – Shil road and KDMC road (Kalyan Dombivli Municipal Corporation) also needs the maintenance work.

Western Suburbs, Mumbai

Borivali in Mumbai is one of the suburbs beyond the Western Suburbs that is undergoing re-development. This location is offering the tall buildings of up-to 15 floors, which is giving the beautiful view of the Sanjay Gandhi National Park, but only some residents will get this view. Before two years, State Government relaxed the DCR (Development Control Rules) for the Western Suburbs by providing extra Floor Space Index (FSI). This move attracted some well known real estate builders for re-development of the area, which was otherwise packed with mid-rise structures.

According to the owner of Mumbai Porpeties, Ramprasad Padhi, “These policy changes will change the phase of real estate. New supply which came in was a good opportunity for first time home buyers as well as investors”. This new stock of property also evolved the quality of life, here as it has brought young buyers to the area. Vishesh Mehrotra owner of City Home Solutions, stated that “With rising disposable incomes of working couples, several shopping malls and multiplexes have also come up which has changed the look and feel of the area”.

Present scenario of Borivali in Mumbai:

Properties in Borivali West are in the range of Rs 45 lakh for a 1BHK unit whereas it can go up-to Rs 8 crore for a 3500 sq ft, 4BHK unit. The eastern counterpart of Borivali locality has a number of housing units that offers a green view of the Sanjay Gandhi National Park but is priced in a budget range of Rs 1-3 crore for a large, 2BHK unit of 1000-1200 sq ft. however, lack of large layouts is keeping away the township projects from the area.
